Tour Reservation Form
By assigning your
signature to the reservation form or paying a deposit
on any booking you accept the Terms and Conditions as
a binding contract between Moto Provencale and You,
as the rider and/or passenger.
Release and Waiver of Rights
"By reserving
a place on a Moto Provencale tour I agree to a waiver
of rights for third party claims against Moto Provencale
and/or their employees, subcontractors and/or and service
providers. As a participant in the Tour I am
aware that motorcycling is an enjoyable sport, but can
also be dangerous. I am fully aware that as a
rider and/or passenger, factors beyond the control of
Moto Provencale can occur and affect the risk of operating
a motorcycle. I am a licensed motorcyclist and physically
capable of operating a motorcycle under any and all
conditions that may be present or occur during the Tour.
As a passenger, I agree that I understand and accept
the risks of participating in the Tour. Whether participating
as a rider or a passenger, I accept those risks and
agree to hold harmless Moto Provencale for any liability
associated with bodily injury, property damage or third
party claims that may occur during my participation
in the Tour. I have also read and understand these Terms
and Conditions and agree to abide by them in full. "
Reservation, Deposit,
Cancellation Fee and Refunds
All tours require
a deposit in UK Sterling by cash, check, VISA or MasterCard
(deposits can be accepted in Euros via bank transfer
only) prior to and no later than the deadline date established
on the Tour information. A deposit of 20% of the published
tour price is required to secure a reservation for one
rider and a motorcycle. And additional deposit of 20%
of the published passenger price is required to secure
a reservation for a passenger. The balance is due 60
days prior to the first day of the tour. If full payment
is not received 60 days prior to the tour, Moto Provencale
may apply a cancellation fee in accordance with the
following terms of refund. Cancellations received before
60 days prior to the tour are subject to forfeiture
of 10 percent of the published tour price per person.
Cancellations receive 59 to 30 days prior to the first
day of the tour are subject to forfeiture of 40 percent
of the published tour price per person. Cancellations
received 29 to 21 days prior to the first day of the
tour are subject to forfeiture of 60 percent of the
published tour price. Cancellations received 20 days
or less prior to the first day of the tour are subject
to 100 percent forfeiture of the published tour price.
You are responsible for any and all legal fees or court
cost incurred by Moto Provencale in the collection of
cancellation fees.
Refunds will not be provided to participants once the
tour commences, unless otherwise specified in the Terms
and Conditions. No refunds will be provided for missed
meals, lodging, or other tour activities. A tour confirmation
will not be provided in the absence of a signed and
dated tour reservation form or deposit and any deposit
will be returned immediately in full and recognized
as the equivalent of a tour cancellation without financial
penalty.
Motorcycle Use
Rental motorcycles
are subject to the damage deposit accompanying the motorcycle
at the time of reservation. The damage deposit must
be secured with cash, VISA, or MasterCard at the time
of hand over rental. Insurance for physical damage,
less the damage deposit is included with the rental
motorcycle. In case of any accident or loss no matter
whose fault or however caused the full security deposit
will be taken. When all costs of repair or replacement
have been met any balance of the security deposit remaining
will be refunded.
At the beginning
of the tour, Moto Provencale reserves the right to substitute
a motorcycle of similar make and model, subject to availability
attributable to unforeseen circumstances. Once the tour
has commenced, and a rental motorcycle experiences mechanical
failure not attributable to use of the motorcycle outside
of normal riding conditions, collision or theft during
the tour, a substitute motorcycle will be provided within
one business day. If a motorcycle cannot be provided
within one business day, the motorcycle rental portion
of the Tour will be pro-rated for the remainder of the
Tour and a pro-rated refund will be provided to You.
In the event of collision involving a rental motorcycle,
it is at the sole discretion of Moto Provencale to provide
a replacement motorcycle. Moto Provencale is not required
to provide a replacement motorcycle in the event of
a collision. Additional charges rental and insurance
charges associated with rental of a replacement motorcycle
as the result of collision are the sole responsibility
of You. A delivery charge of £1.00 per mile or
1 Euro per kilometer will be charged, in addition to
the rental charge and insurance charges, for a motorcycle
replaced as the result of collision. No rental credit
is available for the loss of use of a rental motorcycle
involved in a collision.
Rental Motorcycles
A rental contract
accompanies every motorcycle rental at the point of
pick-up. You agree to abide by the terms and conditions
of the rental contract accompanying the motorcycle.
Rental motorcycles that are damaged in a collision are
subject to transportation recovery fees of £1.00
per mile or 1 Euro per kilometer for retrieval and transport
of the damaged motorcycle from the point of collision
or temporary storage to the original rental point. You
also agree to comply with all physical damage deductible
requirements accompanying the rental motorcycle. If
legal action is required to recovery physical damage
deductibles owed under your rental contract, you agree
that such fees are recoverable by Moto Provencale from
you. You are entitled to an advance copy of a motorcycle
contract and Moto Provencale will provide one upon request
in advance of your rental.
Price of the
Tour Includes
Motorcycle rental,
hotel accommodations with breakfast, airport shuttle
to and from the base Hotel on the first and last days
of the tour, GPS rental, maps, tour booklet, tour guide
service, tolls and parking fees when accompanied by
a tour guide.
Price of the
Tour Does Not Include
Any items not specifically
described in "Price of the Tour Includes"
section of the Terms and Conditions.
Tour Route
Moto Provencale
reserves the right to change the tour route during the
tour for unforeseeable circumstances, including but
not limited to government action, weather conditions,
hotel availability, and a tour participant's riding
ability.
N.B. If any
tour attracts less than three riding clients we will
change the tour route to the "Provence Tour".
Room Allocation
If not specifically
requested by a solo tour participant, all solo riders
will be booked in single rooms and are liable for the
full price of a solo rider and single room tour supplemental
charge. If a solo rider requests a shared room they
will be booked with a roommate for the duration of the
tour. All requests for roommates must be noted on the
space provided on the reservation form. In the event
that your roommate cancels their tour prior to the start
of the tour, or a roommate cannot be assigned to you,
you are responsible for the single room supplemental
cost listed for the respective tour.
Failure to Comply
with Traffic Laws and Travel Rules of Moto Provencale
If the customer
fails to comply with traffic laws in the country of
travel Moto Provencale reserves the right to secure
the rental motorcycle. Consumption of alcohol or other
controlled substances is strictly forbidden while operating
the rental motorcycle. Consumption of alcohol or other
controlled substances will result your dismissal from
further participation in the tour. In the event you
are barred from tour participation under these Terms
and Conditions, the tour participant is ineligible to
receive any refund of the tour price. Any additional
transportation or other costs incurred at the discretion
of the tour participant who been barred from tour participation
due to consumption of alcohol or controlled substances
are the sole responsibility of the tour participant.
Responsibility
of Moto Provencale
Moto Provencale
is responsible for providing only the services listed
in the Terms and Conditions. Moto Provencale is not
responsible or liable for accidents involving tour participants
or third parties. As a participant in Moto Provencale's
tours, schools or holidays you accept the inherent risk
in participating in motorcycling and motorcycling-related
activities and agree to hold harmless all Moto Provencale
and the sponsoring motorcycle retailer owners and employees
for actions undertaken by you or others.
Luggage
Moto Provencale
will be responsible for baggage while that baggage is
the care, custody and control of Moto Provencale. Moto
Provencale is not responsible for damage, destruction
or theft incurred to baggage during air, rail or other
method of conveyance during the Tour.
Weather Conditions
Moto Provencale
is not responsible for the weather conditions on the
Tour. Tour participants should be prepared for all weather
conditions, including but not limited to, extreme temperature
changes, rain, wind, sleet or snow. No refunds will
be provided for unpleasant or uncomfortable weather
conditions.
Tour Rates
The published
tour price remains in effect for the duration of the
Tour, regardless of the exchange rate between the UK
Pound Sterling and currencies in the countries of travel.
Insurance
Moto Provencale
offers optional trip cancellation insurance at a surcharged
rate of 5% of the total tour price per person. If You
elect to decline this trip cancellation insurance you
are subject to all cancellation penalties as described
in the Reservation, Deposit, Cancellation Fee and Refunds
section of the Terms and Conditions. Moto Provencale
does not provide any other type of insurance for any
tour participant, including but not limited to, health,
accidental death or dismemberment, disability, life
insurance, or physical damage and/or liability associated
with the rental motorcycle. Insurance for physical damage
and liability is provided by the titled owner of the
motorcycle, and the rider is responsible for meeting
the deductible requirement. The owner of the motorcycle
is responsible for providing all insurance for the motorcycle
you chose to use.
Minimum Registrations
A minimum of
3 tour participants is required to confirm any Tour.
Moto Provencale reserves the change the itinery of a
tour if a minimum of 3 tour participants have not registered
5 days prior to the first day of the Tour or by an alternative
published date, if established. In the exceptional
event of a tour being completely cancelled clients will
be given the choice of a full refund or a holiday of
equivalent value based in St Remy de Provence.
Age Limit and
Non-Participating Tour Members
Minimum age
for rider participation on the tour is 30 years as of
the first day of the Tour. Minimum age for passenger
participation is 16 years as of the first day of the
Tour.
Changes in the
Terms and Conditions
Any changes to these
Terms and Conditions must be made in writing and accepted
by all parties. Unilateral changes in the Terms and
Conditions by any party are not binding.
